This Credit Guide is required to be given to you under the National Consumer Credit Protection Act 2009 (Cth) (NCCP Act) before or when we provide credit assistance to you. Please read this document carefully and retain it for your records.

1. About New Direction Finance
New Direction Finance (referred to in this guide as 'we', 'us', or 'our') is a credit assistance provider under the National Consumer Credit Protection Act 2009 (Cth) (NCCP Act). We are an authorised credit representative (ACR No. 499888) of the Australian Credit Licence holder (ACL No389527. ), as registered with the Australian Securities and Investments Commission (ASIC).
We act as a mortgage and finance broker, providing credit assistance to consumers and businesses seeking finance including home loans, investment loans, refinancing, personal loans, and related finance products.
We do not act as a lender. Our role is to help you identify and apply for credit products that may be suitable for your needs, objectives, and financial situation.
1.1 Our Licence Obligations
As an authorised credit representative, we and the ACL holder (ACL No 389527. ) are required to:
• Act efficiently, honestly, and fairly in all dealings with you;
• Have adequate arrangements in place to manage conflicts of interest;
• Ensure our representatives are adequately trained and competent;
• Maintain adequate professional indemnity insurance;
• Comply with the responsible lending obligations in Chapter 3 of the NCCP Act;
• Provide you with this Credit Guide and, where applicable, a Credit Proposal Disclosure document.
2. Services We Provide
We provide credit assistance services, which include:
• Suggesting, recommending, or assisting you to apply for a particular credit contract;
• Suggesting you remain in or increase your credit limit under an existing credit contract;
• Assessing your borrowing capacity and financial position;
• Preparing and lodging loan applications on your behalf;
• Liaising with lenders during the assessment and approval process;
• Providing guidance on loan features, structures, and repayment strategies.
Credit assistance does not mean we will guarantee you credit. Whether credit is approved remains at the sole discretion of the lender.

3. Our Lender Panel and How We Select Products
We work with a panel of lenders and credit providers. The lenders on our panel may change from time to time. A current list of lenders on our panel is available on request.
3.1 How We Recommend a Product
When we make a recommendation, we will:
• Assess your financial situation, objectives, and requirements;
• Consider products available through our lender panel that may meet your needs;
• Explain the basis of our recommendation;
• Provide you with a Credit Proposal Disclosure document before you apply for or enter a credit contract.
We will not recommend a credit product that is unsuitable for you based on your stated needs, objectives, and financial situation.
3.2 Limited Product Scope
Our recommendations are limited to products available through lenders on our panel. We do not have access to all credit products available in the market. You should consider whether obtaining independent financial advice is appropriate before committing to any credit contract.
4. Responsible Lending Obligations
We are required under the NCCP Act to comply with responsible lending obligations. This means we must not provide credit assistance to you if the credit contract would be unsuitable for you.
4.1 When a Credit Contract Is Unsuitable
A credit contract is unsuitable for you if:
• You will be unable to comply with your financial obligations under the contract, or could only do so with substantial hardship; or
• The credit contract does not meet your requirements or objectives.
4.2 What We Need From You
To meet our responsible lending obligations, we will ask you to provide information about your:
• Income, assets, liabilities, and living expenses;
• Credit history and existing financial commitments;
• Employment status and stability;
• Objectives and requirements for obtaining credit;
• Intentions regarding the use of the credit product.
You must provide us with accurate and complete information. Providing false or misleading information may affect your ability to obtain credit and may constitute an offence under applicable law.
4.3 Preliminary Assessment
We will conduct a preliminary assessment of whether the credit contract is not unsuitable for you before we suggest, recommend, or assist you to apply for credit. 5. Fees and Charges
5.1 Fees We Charge You
We may charge you a fee for our credit assistance services. Any fees payable by you will be disclosed to you in writing before you are required to pay them. The nature and amount of any fee will depend on your individual circumstances and the services provided.

We will always disclose any fee payable by you in writing prior to you incurring any obligation to pay that fee.
5.2 Commissions and Remuneration From Lenders
We may receive remuneration from lenders when we successfully introduce business to them. This is typically in the form of:
• Upfront commission: a percentage of the loan amount paid by the lender at settlement;
• Trail commission: an ongoing commission based on the outstanding loan balance, paid periodically by the lender.
These commissions are paid by the lender, not by you, and do not increase the cost of your loan. However, you should be aware that the commissions we receive may influence the products we recommend.
We manage this potential conflict of interest by:
• Always conducting a needs assessment and making recommendations based on your best interests;
• Disclosing the nature of commissions received;
• Not recommending a product solely on the basis of the commission it generates.
5.3 Aggregator Fees

6. Privacy and Collection of Personal Information
We collect, use, hold, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act), the Australian Privacy Principles (APPs), and our Privacy Policy.
6.1 What We Collect
We collect personal information that is reasonably necessary for us to provide you with credit assistance. This includes:
• Identity information (name, date of birth, residential address, contact details, government-issued identification);
• Financial information (income, assets, liabilities, expenses, bank statements, tax returns);
• Employment information;
• Credit history and credit report information;
• Information about your requirements and objectives.
6.2 Why We Collect It
We collect your personal information to:
• Assess your eligibility and suitability for credit products;
• Prepare and submit loan applications on your behalf;
• Comply with our legal and regulatory obligations;
• Communicate with you about your application and our services;
• Prevent fraud and meet our AML/CTF obligations (see Section 7).
6.3 Who We May Disclose It To
We may disclose your personal information to:
• Lenders and credit providers to whom you are applying for credit;
• Credit reporting bodies, in accordance with the Privacy Act;
• Our aggregator or licensee;
• Mortgage insurers, valuers, solicitors, and other third parties involved in the transaction;
• ASIC, AUSTRAC, or other regulatory authorities as required by law;
• Our professional advisers (subject to confidentiality obligations).
We do not sell your personal information to third parties.
6.4 Your Privacy Rights
You have the right to:
• Access the personal information we hold about you;
• Request correction of inaccurate or out-of-date information;
• Complain about a breach of the APPs.

7. Anti-Money Laundering and Counter-Terrorism Financing
New Direction Finance is a reporting entity under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF Act) and the Anti-Money Laundering and Counter-Terrorism Financing Rules Instrument 2007 (No. 1) (AML/CTF Rules).
We are enrolled with the Australian Transaction Reports and Analysis Centre (AUSTRAC) and maintain an AML/CTF Program as required by law.
7.1 Customer Identification and Verification (KYC)
Before we provide you with a designated service, we are required to identify and verify your identity (Know Your Customer — KYC). This obligation applies to:
• Individual customers;
• Companies and other entities;
• Beneficial owners and persons with significant influence or control over an entity.
We will ask you to provide documentation to verify your identity, which may include:

We may use electronic verification services to verify your identity in accordance with the AML/CTF Rules. You consent to us using such services by engaging us.
7.2 Ongoing Customer Due Diligence
We are required to conduct ongoing due diligence on our customers. This means we may periodically ask you to update or re-confirm your identity information and the nature and purpose of our relationship.
7.3 Politically Exposed Persons
If you are, or are closely associated with, a politically exposed person (PEP) — including a foreign government official or senior Australian government officer — we are required to apply enhanced due diligence measures. You must disclose this to us.
7.4 Suspicious Matter Reporting
We are required by law to report suspicious matters to AUSTRAC. If we form a suspicion that a transaction is related to money laundering, terrorism financing, tax evasion, or other criminal activity, we will report this without notifying you (as required by the AML/CTF Act). 7.5 Threshold Transaction Reports
We are required to report to AUSTRAC any cash transaction of AUD $10,000 or more, or multiple related cash transactions that together exceed this threshold.
7.6 Consequences of Non-Compliance

8. Your Rights and Obligations
8.1 Your Right to Independent Advice
You have the right to seek independent legal, financial, or credit advice before entering into any credit contract. We encourage you to do so, particularly for significant financial commitments.
8.2 Your Right to a Credit Proposal Disclosure Document
Before we provide you with credit assistance, we must give you a Credit Proposal Disclosure document that sets out:
• The specific credit product we are recommending;
• The proposed loan amount, term, and repayments;
• The total fees and charges;
• The commissions we will receive;
• The preliminary assessment outcome.
8.3 Your Obligation to Provide Accurate Information
You are obliged to provide us with accurate and complete information. Knowingly providing false or misleading information to obtain credit is a criminal offence under the Criminal Code Act 1995 (Cth) and may expose you to serious legal consequences.
8.4 Hardship Obligations
If you enter into a credit contract and experience financial difficulty, you may have rights under the National Credit Code (Schedule 1 to the NCCP Act) to request a hardship variation from your lender. Contact your lender as soon as possible if you are experiencing financial difficulty.

We will acknowledge your complaint within 1 business day and aim to resolve it within 30 calendar days. For complex complaints, we will keep you informed of our progress.
9.2 External Dispute Resolution
If you are not satisfied with our response to your complaint, or if your complaint is not resolved within 30 days, you may refer the matter to the Australian Financial Complaints Authority (AFCA):

10. Conflicts of Interest
We are committed to managing conflicts of interest in a way that ensures we act in your best interests. Potential conflicts include:
• Commission structures that may favour higher loan amounts or particular lenders;
• Volume bonuses offered by lenders;
• Referral arrangements with third parties.
We manage conflicts of interest through our internal Conflicts of Interest Policy, staff training, disclosure to clients, and by ensuring recommendations are based on your individual needs and circumstances. A copy of our Conflicts of Interest Policy is available on request.
11. Professional Indemnity Insurance
We hold professional indemnity insurance that covers claims arising from acts, errors, and omissions in our credit assistance activities, in accordance with ASIC requirements under our Australian Credit Licence conditions.
12. Referrals
12.1 Referrals to Us
If you have been referred to us by a third party (such as a real estate agent, financial planner, or accountant), that third party may receive a referral fee or commission from us. The amount and nature of any such referral payment will be disclosed to you before we provide credit assistance.
12.2 Referrals From Us
